1. Acceptance of Terms & Eligibility

By accessing hardiksapra.com, installing, or invoking our ChatGPT Plugins and Model Context Protocol (MCP) tools (including MVP Architect & PRD Specifier and DocExtract JSON Engine), you agree to be bound by these Terms of Service.

You must be at least 13 years of age (or the minimum legal age in your jurisdiction) to access or use these tools. If you are under 18, you represent that you have parental or legal guardian consent.

2. Permitted Use & Service Descriptions

Our tools are provided to assist software developers, product managers, and founders with technical planning and data extraction:

• MVP Architect: Synthesizes product specifications into formatted PRDs, Mermaid diagrams, database schemas, and 30-day feasibility sprint estimations.
• DocExtract Engine: Heuristically extracts available fields and clause signals from supplied invoice and contract text, checks declared arithmetic, and previews webhook payloads without sending them.

You agree to use these services solely for lawful, authorized purposes and in strict accordance with the OpenAI Usage Policies.

3. Prohibited Content, Goods & Activities

In adherence to the OpenAI Plugin Guidelines, you agree that you will not use our tools to create, facilitate, plan, or promote any of the following prohibited goods or services:

• Prohibited Goods: Weapons, explosives, firearms, ammunition; illegal drugs, cannabis, or prescription-only medications; counterfeit, stolen, or pirated goods; adult content or sexual services; malware, spyware, keyloggers, or unauthorized surveillance devices.
• Prohibited Deceptive Services: Document forgery, fake IDs; debt relief or credit repair schemes; deceptive cryptocurrency/NFT schemes; money laundering or execution of unauthorized financial transactions.
• Restricted Data Input: You strictly agree not to submit Payment Card data (PCI DSS), Protected Health Information (PHI), government-issued IDs, or authentication secrets/passwords into tool prompts.
• System Abuse: You agree not to attempt denial-of-service attacks, reverse engineering, unauthorized API scraping, circumventing rate limits, or injecting malicious prompt payloads.

4. Commerce & Sprint Consulting Transparency

• Invoking request_mvp_consultation or request_pipeline after explicit consent records a follow-up inquiry. It does not schedule a meeting or guarantee a response time.
• All PRDs, architecture specifications, sprint estimates, invoice extractions, arithmetic checks, and contract-clause signals are informational aids. They do not constitute legal advice, accounting certification, fraud findings, a binding commercial contract, or a delivery guarantee.
• Formal engineering sprint engagements, deliverables, warranties, and payments require a separate, mutually executed written Sprint Agreement executed directly with Hardik Sapra.

5. Intellectual Property Rights

• Your Deliverables: You retain full ownership and intellectual property rights to the unique inputs you submit and the resulting custom architectural deliverables, PRDs, and schemas generated specifically for your project.
• Our Platform: Hardik Sapra retains all intellectual property rights, titles, and interests in the underlying plugin software, MCP servers, schemas, prompts, documentation, and the hardiksapra.com platform.

6. Disclaimer of Warranties

Our plugins and tools are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that tool outputs will be completely error-free or that system operations will be uninterrupted.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Hardik Sapra shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or commercial opportunities arising out of or related to your use of or inability to use the tools or generated specifications.

8. Platform Ecosystem Governance

These plugins operate within the OpenAI ChatGPT and Codex platform ecosystem. Your use is simultaneously subject to the OpenAI Terms of Use. Violation of OpenAI policies may result in immediate revocation of plugin access.

9. Modifications & Termination

We reserve the right to modify these Terms of Service or discontinue any tool feature at any time to reflect legal, regulatory, or technical changes. Continued use of our plugins after notice constitutes acceptance of updated terms.
